This Statement governs our relationship with users and others who interact with topSTUNTZ. Your use of topSTUNTZ and any products, software and services is subject to the terms of a legal agreement between you and topSTUNTZ. This document forms a legally binding agreement between you and topSTUNTZ in relation to your use of the Services. It is important that you take the time to read them carefully.
By using or accessing topSTUNTZ, you agree to this Statement and accept the practices it describes. You may not use the Services if you do not accept the Terms. You may not use the Services and may not accept the Terms if you are a person who is either barred or otherwise legally prohibited from receiving or using the Services under the laws of the country in which you are resident or from which you access or use the Services.
This statement is broken up into four major sections; ‘Terms of Use’, ‘Privacy Policy’, ‘Community Guidelines’ and ‘Copyright Notice’.
1. Terms of Use

1.1.2. Acrobatics can be a high risk dangerous physical activity; always seek professional coaching/guidance when participating in such activities.
1.1.3. topSTUNTZ.com is not responsible for any injuries obtained whilst participating in any physical activity that may be related to the subject of this website.
1.1.4. The content (including videos) that topSTUNTZ.com provides is for entertainment purposes only.
1.1.5. Any guides or tutorial videos on this site have not been validated as official teaching or learning material and are therefore used at your own risk.
1.1.6. Users of topSTUNTZ.com are responsible for any content or information they add to the website.
1.1.7. All content provided must be suitable for people of all ages.
1.1.8. topSTUNTZ.com reserve the right to remove any material from the site without warning.
1.1.9. By providing content to topSTUNTZ.com you are giving permission for it to be used in whatever way is considered reasonable practice.
1.1.10. You agree to have the limited personal data you supplied to topSTUNTZ.com used and displayed within the site.
1.2. General Restrictions On Use
1.2.1. You agree not to access User Submissions or other content made available on the Website through any technology or means other than the pages of the Website itself.
1.2.2. You agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Website or features that (i) prevent or restrict use or copying of any User Submissions or topSTUNTZ Content or (ii) enforce limitations on use of the Website or the content accessible on the Website.
1.2.3. You agree not to use the Website or any Services for any commercial use, without the prior written authorisation of topSTUNTZ.
1.2.4. You agree not to use the Website and the Services for the solicitation of business in the course of trade or in connection with a commercial enterprise.
1.2.5. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.
1.3. Safety
We do our best to keep topSTUNTZ safe, but we cannot guarantee it. We need your help in order to do that, which includes the following commitments:
1.3.1. You will not send or otherwise post unauthorized commercial communications to users (such as spam).
1.3.2. You will not upload viruses or other malicious code.
1.3.3. You will not solicit login information or access an account belonging to someone else.
1.3.4. You will not bully, intimidate, or harass any user.
1.3.5. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
1.3.6. You will not use topSTUNTZ to do anything unlawful, misleading, malicious, or discriminatory.
1.3.7. You will not facilitate or encourage any violations of this Statement.
1.4. Sharing Your Content and Information
1.4.1. In order for us to use certain types of content and provide you with topSTUNTZ, you agree to the following:
1.4.2. When you upload or post a User Submission to topSTUNTZ, you grant:
to topSTUNTZ, a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare derivative works of, display, and perform that User Submission in connection with the provision of the Services and otherwise in connection with the provision of the Website and topSTUNTZ business, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels;
to each user of the Website, a worldwide, non-exclusive, royalty-free, licence to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions to the extent permitted by the functionality of the Website and under these Terms.
1.4.3. The above licenses granted by you in User Videos terminate when you remove or delete your User Videos from the Website. The above licenses granted by you in User Comments are perpetual and irrevocable, but are otherwise without prejudice to your ownerships rights, which are retained by you.
1.4.4. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
1.4.5. We always appreciate your feedback or other suggestions about topSTUNTZ, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).
1.5. Registration and Account Security
topSTUNTZ users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
1.5.1. When creating your account, you must provide accurate and complete information. You will not provide any false personal information on topSTUNTZ, or create an account for anyone other than yourself without permission.
1.5.2. You will not upload video if you are under 16.
1.5.3. You will not use topSTUNTZ if you are a convicted sex offender.
1.5.4. You will keep your contact information accurate and up-to-date.
1.5.5. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
1.5.6. You will not transfer your account to anyone without first getting our written permission.
1.5.7. You must notify topSTUNTZ immediately of any breach of security or unauthorised use of your topSTUNTZ account that you become aware of.
1.5.8. You agree that you will be solely responsible (to topSTUNTZ, and to others) for all activity that occurs under your topSTUNTZ account.
1.6. Website Content
1.6.1 You understand and agree that you are solely responsible for your own User Submissions and the consequences of posting or publishing them. topSTUNTZ does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and topSTUNTZ expressly disclaims any and all liability in connection with User Submissions.
1.6.2. You represent and warrant that you have (and will continue to have during your use of the Services) all necessary licenses, rights, consents, and permissions which are required to enable topSTUNTZ to use your User Submissions for the purposes of the provision of the Services by topSTUNTZ, and otherwise to use your User Submissions in the manner contemplated by the Website and these Terms.
1.6.3. You further understand and acknowledge that in using the Website and the Services, you may be exposed to User Submissions that are factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against topSTUNTZ with respect to any such User Submissions.
1.6.4. With the exception of User Submissions, all other content on the Website including, without limitation, the text, software, scripts, graphics, photos, sounds, music, videos and interactive features on the Website is either owned by or licensed to topSTUNTZ, and is subject to copyright, trade mark rights, and other intellectual property rights of topSTUNTZ or topSTUNTZ licensors. Any third party trade or service marks present on the topSTUNTZ Content are trade or service marks of their respective owners.
1.6.5. topSTUNTZ Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of topSTUNTZ, or topSTUNTZ licensors. topSTUNTZ reserves all rights not expressly granted in and to the topSTUNTZ Content.
1.7. Protecting Other People’s Rights
We respect other people's rights, and expect you to do the same.
1.7.1. You will not post content or take any action on topSTUNTZ that infringes someone else's rights or otherwise violates the law.
1.7.2. We can remove any content you post on topSTUNTZ if we believe that it violates this Statement.
1.7.3. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
1.7.4. If you collect information from users, you will: obtain their consent, make it clear you (and not topSTUNTZ) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
1.7.5. You will not post anyone's identification documents or sensitive financial information on topSTUNTZ.
1.8. Mobile Web
1.8.1. topSTUNTZ is currently not compatible with mobile phones.
1.9. Amendments
1.9.1. The collection of terms displayed on topSTUNTZ.com at any time are the set in use.
1.9.2. topSTUNTZ may make changes to the Terms from time to time. When these changes are made, topSTUNTZ will make a new copy of the Terms available at http://www.topstuntz.com/?r=terms showing the date from which it is active.
1.9.3. You understand and agree that if you use the Services after the date on which the Terms have changed, topSTUNTZ will treat your use as acceptance of the updated Terms.
1.9.4. You should check the Terms regularly for changes.
1.10. Language
1.10.1. The terms are provided in English. Any translation is provided for your convenience only and you agree that the English language versions of the Terms will govern your relationship with topSTUNTZ.
1.11. Ending Your Relationship With topSTUNTZ
1.11.1. If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of topSTUNTZ to you. We will generally try to notify you, but have no obligation to do so. You may also delete your account at any time.
1.11.2. The Terms will continue to apply until terminated by either you or topSTUNTZ as set out below.
1.11.3. If you want to terminate your legal agreement with topSTUNTZ, you may do so by closing your topSTUNTZ account.
1.11.4. topSTUNTZ may at any time, terminate its legal agreement with you if:
you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or
topSTUNTZ is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or
topSTUNTZ is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the Services; or
the provision of the Services to you by topSTUNTZ is, in topSTUNTZ opinion, no longer commercially viable.
1.11.5. When these Terms come to an end, all of the legal rights, obligations and liabilities that you and topSTUNTZ have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation.
1.12. Definitiions
1.12.1. By 'topSTUNTZ' we mean the features and services we make available, including through (a) our website at http://www.topstuntz.com and any other topSTUNTZ branded or co-branded websites (including sub-domains, international versions, and mobile versions); (b) our Platform; and (c) other media, devices or networks now existing or later developed.
1.12.2. By 'us,' 'we' and 'our' we mean topSTUNTZ, Inc. and/or its affiliates.
1.12.3. By 'Platform' we mean a set of APIs and services that enable applications, developers, operators or services to retrieve data from topSTUNTZ and provide data to us relating to topSTUNTZ users.
1.12.4. By 'content' we mean any media content and information you provide on topSTUNTZ, including information about you and the actions you take.
1.13. Other
1.13.1. This Statement makes up the entire agreement between the parties regarding topSTUNTZ, and supersedes any prior agreements.
1.13.2. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
1.13.3. If we fail to enforce any of this Statement, it will not be considered a waiver.
1.13.4. Any amendment to or waiver of this Statement must be made in writing and signed by us.
1.13.5. You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.
1.13.6. All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
1.13.7. Nothing in this Agreement shall prevent us from complying with the law.
1.13.8. This Statement does not confer any third party beneficiary rights.
1.14. General legal terms
1.14.1. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
1.14.2. The Terms, and your relationship with topSTUNTZ under the Terms, shall be governed by English law. You and topSTUNTZ agree to submit to the exclusive jurisdiction of the courts ofEngland
1.15. Exclusion of Warranties
1.15.1. Nothing in the Terms shall affect any statutory rights which you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.
1.15.2. The Services are provided 'as is' and topSTUNTZ makes no warranty or representation to you with respect to them. We try to keep topSTUNTZ up, bug-free, and safe, but you use it at your own risk. We do not guarantee that topSTUNTZ will be safe or secure.
1.15.3. In particular topSTUNTZ does not represent or warrant to you that:
your use of the Services will meet your requirements,
your use of the Services will be uninterrupted, timely, secure or free from error,
any information obtained by you as a result of your use of the Services will be accurate or reliable,
that defects in the operation or functionality of any software provided to you as part of the Services will be corrected.
1.15.4. No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Services except to the extent that they are expressly set out in the Terms.
1.16. Limitation of Liability
1.16.1. Nothing in these Terms shall exclude or limit topSTUNTZ liability for losses which may not be lawfully excluded or limited by applicable law.
1.16.2. topSTUNTZ shall not be liable to you for:
any indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you;
any loss or damage which may be incurred by you as a result of:
any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Services;
any changes which topSTUNTZ may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services);
the deletion of, corruption of, or failure to store, any User Submissions and other communications data maintained or transmitted by or through your use of the Services;
your failure to provide topSTUNTZ with accurate account information;
your failure to keep your password or topSTUNTZ account details secure and confidential.
1.16.3. The limitations on topSTUNTZ liability to you shall apply whether or not topSTUNTZ has been advised of or should have been aware of the possibility of any such losses arising.
2. Privacy Policy
Your privacy is very important to us. We designed our privacy policy to inform you about how we collect and use the information and media you post on topSTUNTZ. We encourage you to read the following, and to use the information it contains to help make informed decisions.
2.1. topSTUNTZ Principles
2.1.1. We built topSTUNTZ.com to make it easy to share your video media and display your skills with your sports community and others with similar interests. We hope to provide a quick and easy method of connecting you with similar people around the world. topSTUNTZ is publically open worldwide so please consider this when choosing what information you share on topSTUNTZ.com.
2.1.2. You have control over the content you provide. You can also remove it at anytime. topSTUNTZ.com help you share media and information with other interested parties. You choose what information you put in your profile. The only information you must provide is your name, gender, D.O.B. and country. You have access to the information and media others want to share. We have designed the site to help you access this more easily.
2.2. Personal Information
2.2.1. You can watch videos on topSTUNTZ without having a topSTUNTZ Account. You can also contact us through the contact page or by emailing us directly, without having to register for an account.
2.2.2. For some activities on topSTUNTZ, such as uploading videos, posting comments or sending messages, you need a topSTUNTZ Account. We ask for some personal information when you create an account, including your email address and a password, which is used to protect your account from unauthorised access.
2.2.3. When you use topSTUNTZ, we may record information about your usage of the site, such as the pages you view and which users you communicate with.
2.2.4. Any personal information or video content that you voluntarily disclose online (e.g. video comments, your profile page) may be collected and used by others.
2.3. Information That is Publicly Available
2.3.1. When you create a topSTUNTZ Account, some information about your topSTUNTZ account and your Account activity will be provided to other users of topSTUNTZ. This may include the date that you opened your topSTUNTZ Account, the date that you last logged in to your topSTUNTZ Account, your age, the country and the number of videos that you have watched.
2.3.2. Your name, not your email address, is displayed to other users when you engage in certain activities on topSTUNTZ, such as when you upload videos or send messages through topSTUNTZ. Other users can contact you by leaving a message or comment on the site.
2.3.3. Any videos that you submit to topSTUNTZ may be redistributed through the Internet and other media channels and may be viewed by other topSTUNTZ users or the general public.
2.3.4. You may also choose to add other personal information that will be visible to other users on your topSTUNTZ profile. Such shared activity may include your favourite videos, videos that you rated and videos that you have uploaded.
2.4. The information we collect
2.4.1. When you visit topSTUNTZ you provide us with two types of information: personal information you knowingly choose to disclose that is collected by us and Website use information collected by us as you interact with our Website.
2.4.2. When you register with topSTUNTZ, you provide us with certain personal information, such as your name, your email, your gender, your D.O.B. and any other personal information that you provide to us.
2.4.3. When you enter topSTUNTZ, we collect your browser type and IP address. This information is gathered for all topSTUNTZ visitors. In addition, we store certain information from your browser using 'cookies'. A cookie is a piece of data stored on the user's computer tied to information about the user. We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser.
2.4.4. When you use topSTUNTZ, you may set up your personal Profile, form relationships, send messages, perform searches and queries, form/join groups and transmit information through various channels. We collect this information so that we can provide you the service and offer personalised features. In most cases, we retain it so that, for instance, you can return to view prior messages you have sent.
2.4.5. You post User Content on the Site at your own risk. Although we have security measures in place to protect your content, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.
2.4.6. Any improper collection or misuse of information provided on topSTUNTZ is a violation of the topSTUNTZ Terms of Use and should be reported.
2.4.7. By using topSTUNTZ, you are consenting to have the limited personal data you supplied visible by the other users of the site.
2.5. Minors Under 16
2.5.1. As topSTUNTZ.com is a publically viewable website we only display and store a limited amount of personal data. Content on the website is suitable for users of all ages however you should not upload videos to the site if you are under 16 years old.
2.6. Use of information obtained by topSTUNTZ
2.6.1. When you register with topSTUNTZ, you create your own profile and control the media you display. Your profile information, as well as your name, age, gender, country and photo are displayed to other users of the site to enable you to connect with people on topSTUNTZ. We may occasionally use your name and email address to send you notifications regarding activity on topSTUNTZ that we think you may find valuable. Generally, you can control which notifications you receive.
2.6.2. Profile information is used by topSTUNTZ primarily to be presented back to and edited by you when you access the service and to be presented to other users of the site. In some cases (e.g. posting to your message board), other topSTUNTZ users may be able to supplement your Profile.
2.7. Sharing your information with third parties
2.7.1. The content that you can view on topSTUNTZ can be viewed by anybody else. topSTUNTZ.com is a publically open website so we have no need to actively share your information with third parties in any other way. topSTUNTZ never give out your contact details to third parties.
2.7.2. When you use topSTUNTZ, certain information you post or share, such as personal information, comments, messages, photos, videos, or other information, will be shared with other users. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your Profile or when posting comments, messages, photos, videos, or other items, this information will become publicly available.
2.8. Links
topSTUNTZ may include hyperlinks to other websites that are not owner or controlled by topSTUNTZ. topSTUNTZ has no control over, and assumes no responsibility for the content, privacy policies or practices of any third party websites. We encourage our users to be aware when they leave our site that they should read the privacy statements of each and every website that collects personally identifiable information. The Privacy Policy contained here applies solely to information collected by topSTUNTZ.
2.9. Third Party Advertising
2.9.1. Advertisements that appear on topSTUNTZ are sometimes delivered directly to users by third-party advertisers. They automatically receive your IP address when this happens. These third-party advertisers may also download cookies to your computer or use other technologies such as JavaScript and web beacons to measure the effectiveness of their adverts and to personalise advertising content. Doing this allows the advertising network to recognise your computer each time they send you an advertisement in order to measure the effectiveness of their adverts and to personalise advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. topSTUNTZ does not have access to or control of the cookies that may be placed by the third-party advertisers. Third-party advertisers have no access to your contact information stored on topSTUNTZ unless you choose to share it with them.
2.9.2. topSTUNTZ strives to provide you with relevant and useful advertising. We use specific sponsors and advertisers as well as third-party ad-serving systems, to do so. We may use a range of information, including cookies, web beacons, IP addresses, usage data and other non-personal information about your computer or device (such as browser type and operating system) to provide you with relevant advertising. If you are logged in to your topSTUNTZ Account, we may also show you advertising based on the information that you have provided to us in your topSTUNTZ Account.
2.9.3. Advertisers may serve ads based on interests associated with non-personally identifiable online activity, such as videos viewed, frequency of uploading or activity on third-party ad-serving companies. Advertisers may also serve ads to you based on previous activity on that advertiser's website. This non-personally identifiable information is held separately from your topSTUNTZ Account data or other personally identifying information in our possession.
topSTUNTZ does not provide any personal information to these third-party ad servers or ad networks without your consent. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt out of certain practices. topSTUNTZ privacy policy does not apply to and we cannot control the activities of such other advertisers or websites. Any data obtained by third-party ad servers subsequently shared with topSTUNTZ are maintained and dealt with by topSTUNTZ in accordance with this Privacy Policy.
2.10. Changing or removing information
2.10.1. Access and control over most personal information on topSTUNTZ is readily available through the Profile editing tools. topSTUNTZ users may modify or delete any of their Profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to remove their topSTUNTZ account may do so on the account page. Removed information may persist in back-up copies for a reasonable period of time but will not be generally available to members of topSTUNTZ.
2.10.2. Where you make use of the communication features of the service to share information with other individuals on topSTUNTZ, (e.g. rating a video or sending a personal message to another topSTUNTZ user) you generally cannot remove such communications.
2.11. Security
2.11.1. topSTUNTZ takes appropriate precautions to protect our users' information. Your account information is located on a secure server behind a firewall. Your password is stored in an encrypted form using a one-way encryption algorithm so we do not have access to this data.
3. Community Guidelines
3.1. Get involved
3.1.1. topSTUNTZ.com is a fun website for everyone to use. We encourage you to get involved – your involvement makes the site what it is.
3.1.2. Let people know what you think. Feedback's part of the experience, and when done with respect, can be a great way to make friends and make your time on topSTUNTZ more enjoyable. Leave comments, rate videos, encourage others and have a bit of banter. The site is designed to demonstrate your skills and have some friendly competition.
3.1.3. There's a lot going on and everyone can get involved no matter what your skill level or experience. topSTUNTZ.com – Bringing together sports communities with a shared interest and appreciation for human skill and achievement.
3.2. topSTUNTZ has been built for the community
3.2.1. Please respect the topSTUNTZ community. We trust you to be responsible when providing content and interacting with other users.
3.2.2. We review all flagged videos and members to determine whether it violates our terms of use. Flagged videos / members are not automatically removed from our system. If it is removed after reviewing it, you should consider that we want as much content as possible and therefore have a good reason for removing it from our site. Try to see it from our perspective and the perspective of other users. If you find other content on topSTUNTZ with the same violations, please flag them so we can review them as well!
3.3. General guidelines
3.3.1. topSTUNTZ.com is exclusively for videos of sports skills, acrobatics, extreme sports and other displays of human achievement and strength. This extends to a wide range of topics and categories for the common interest of a typical topSTUNTZ user.
3.3.2. topSTUNTZ.com provides you with a profile to upload videos of yourself. It is not intended for you to upload videos of other people or portray yourself as somebody else.
3.3.3. If you have a video that does not relate to the intended content of topSTUNTZ.com then please don’t post it here; there are many sites specifically designed for whatever video you may have.
3.3.4. Respect copyright. Only upload videos that you made or that you are authorized to use. This means don't upload videos you didn't make, or use content in your videos that someone else owns the copyright to, such as music tracks or videos made by other users, without necessary authorizations.
3.3.5. topSTUNTZ.com is a public site that anybody can use. Anyone can communicate with anybody else. We encourage free speech and defend everyone's right to express unpopular points of view. But we do not permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status and sexual orientation/gender identity). There is zero tolerance of predatory behaviour, stalking, threats, harassment, invading privacy or the revealing of other members' personal information. Anyone caught doing these things may be permanently banned from topSTUNTZ.
3.3.6. People hate spam. Do not create misleading titles in order to increase views. It's not OK to post large amounts of untargeted, unwanted or repetitive content, including comments and private messages.
